Stoddard's decision to remove the documents from the file of Joanne Cuccia, Lozano's former attorney, led to an outcry from defense attorneys, an avalanche of media attention once video footage of Stoddard's move was released, and a packed house in Donahoe's courtroom Thursday.

Donahoe ordered the courtroom cleared for much of the proceeding after Tom Liddy, an attorney from Maricopa County's civil division representing the Sheriff's Office, raised an objection as Stoddard was starting to explain his decision. When Donahoe opened the court an hour later, the judge explained he closed the hearing to protect the interests of one or more of the parties involved.

Maria Schaffer, an attorney now representing Lozano, indicated she was concerned her client wouldn't get a fair sentencing in Maricopa County because of the media scrutiny Stoddard's hearing has received.

In September, Lozano pleaded guilty to aggravated assault stemming from a November 2008 incident in which Lozano got into a fight with another inmate while both were in custody and awaiting trial in the East Court Building.

It looks like another guilty party might walk free on a technicality.
