A bad thing to put into written law. Except that perhaps doing so will make the already existing practice subject to easier legal challenge. Or not, as Hamdi or Ramsey were grabbed domestically iirc, denied all rights such as counsel or a speedy trial, and only as of the legal challenge mounted at that time did the government relent in their treatment, and proceed to a civil trial where these rights were once again in play.

That's a big flaw in our system right there.

What happens is that when a president violates the law, often the Congress covers that act by later enactment of law allowing it, kind of retroactively giving it a pass. Happened with Lincoln and his suspension of habeas corpus, and happened with W's no-warrant wire-tapping as well.

That is the opposite of the rule of law, when they simply change the previous existing law to make legal what was done illegally by a president.
